Losing an arm in a job-related accident entitles a laborer to the maximum workers compensation benefit by law. This translates to a weekly rate of approximately $400 for the maximum time allotted of 312 weeks in the State of New York. However, an employee with physicians that are unable to heal his lower back trouble could lawfully gather weekly support disbursements for a lifetime. This unusual idiosyncrasy is because of a law established regarding workers comp in 1914. Not all injuries resulting from accidents are covered under the law, but many are bound by a schedule. Hearing loss and dismemberment are two of the injuries which have a specified duration under the law. There are a range of enduring yet partial disabilities that were omitted by the law; these injuries receive payments for the remainder of the worker's life. Included in these are conditions like mental strain or back trouble. Because of this, the workers comp system will pay out in just 13% of related cases, and in the amount of 70% of the full benefit the worker is typically entitled to. The workers comp premium paid in New York is 72 percent above the average around the United States. This has caused a significant drain of tax money, which is effecting local government, schools, and businesses. On the system's opposite side, the limit for workers comp is a benefit of $400 a week, and it now hangs back behind of that region's other states. This faulty system is now being evaluated by local governments within the state of New York. A lot of states have already taken the steps of increasing their maximum payout to a maximum of $686 a week. Texas, previously had one of the worst worker's compensation systems in the nation. However, changes have been made to the system, it has the nation's third-highest worker's compensation costs and the highest rate of injured employees. The speed at which doctors were leaving practice was an additional dilemma facing the state. So the state worked to encourage doctors to join the program or stick with it by creating a law that builds physician networks and gives a boost to the benefits paid to workers injured on the job. Today, Texas' brand new worker' comp law is one of the best ones in America. New York lawmakers have thus far been evaluating the possibility of putting a cap on the amount of time that permanent disabilities can continue to collect. There has also been some discussion of raising the maximum weekly benefit to $500. These modifications would make it easier to eliminate premier fees by as much as 15%. It is anticipated that the government will be releasing other plans to supplement the benefits currently offered. The solution to the problems with worker's compensation is finding a place to compromise. By setting time limits, this will also stop the lifetime benefits that were being paid in cases of back pain and injury. New York need only look to California, a state which has already made such changes to its laws. They were able to petition the state to put the issue up for vote on the ballot. The American public's strong backing of this standing forced the lawmakers to do something on their own. Reform in New York relies on legislative leaders actively pursuing the matter because there is not an option to use a petition. This should be a priority for all state governments across the country, as this is essential to the survival of businesses that are struggling and local governments that can no longer carry the burden.
